How Long Do Labor Cases Take in Kuwait? Stages, Delays, and Case Tracking
By Lawyer Riyadh Al-Fadhli
There is no single guaranteed timeframe for resolving all labor cases in Kuwait. The duration depends on the nature of the claim, the completeness of the documents, service of court notices, and whether expert examination or an appeal is required.
It is therefore important to distinguish between settlement, court proceedings, and enforcement and recovery of the amounts awarded.
This article covers disputes governed by Kuwait’s Private Sector Labor Law No. 6 of 2010. Different procedures may apply to government employees and domestic workers.
How Long Does a Labor Case Take in Kuwait?
Article 144 provides for labor cases to be heard expeditiously. However, this does not establish a fixed number of hearings or guarantee a deadline for judgment.
Under Article 146, a worker or those entitled through the worker must first submit an application to the competent labor department to attempt settlement. If settlement is unsuccessful, the application must be referred to court within one month of submission, accompanied by a memorandum setting out the dispute, both parties’ arguments, and the department’s observations.
Article 147 requires the court registry to schedule a hearing and notify both parties within three days of receiving the application. This is a deadline for scheduling the hearing, not for deciding the case or necessarily holding the hearing within those three days.

Stages of a Labor Case
Stage | What Happens? | What Should You Monitor? |
|---|---|---|
Complaint and settlement attempt | Claims are presented and a possible agreement is discussed | Complaint number, documents, and follow-up appointments |
Referral to court | The dispute moves into court proceedings | Referral details and court case number |
Court proceedings | Claims, responses, and evidence are submitted | Service of notices, hearing dates, and court directions |
Expert examination, if required | Accounts and technical documents are examined | Expert requests and document submission deadlines |
Judgment and appeal, where available | Claims are decided and grounds for challenging the judgment are reviewed | Operative provisions of the judgment and appeal deadlines |
Enforcement | Steps are taken to recover the entitlement awarded | Enforcement file and results of enforcement measures |
This table illustrates a possible case pathway. Not every case goes through all these stages.
Why Can Labor Cases Take Longer?
Factors worth examining when assessing a case include:
Disagreement over actual wages: Particularly where the contract differs from bank transfers or payroll records.
Uncertainty about the service period: Such as a dispute over when employment began or ended.
Multiple claims: Including unpaid wages, end-of-service benefits, unused leave compensation, and damages.
The need for expert examination: Where claims require a review of several accounts or records.
Problems serving court notices: Such as an incomplete company address or inaccurate party details.
Late document submission: Or unclear calculations requiring explanation and a response.
An appeal: Where an appeal is available and a party chooses to pursue it.
Two claims of similar value will not necessarily take the same time. Evidence may be straightforward in one case and disputed in another.
How Many Hearings Does a Labor Case Require?
A worker or employer should not be promised that a case will finish in two or three hearings. A practical estimate becomes more useful after reviewing the file:
Are the documents complete?
Is the wage agreed?
Is an accounting review necessary?
Have notices been properly served?
Ask your lawyer to explain the current stage, the next step, and any existing obstacle, rather than relying only on a predicted completion date before the documents have been reviewed.
How to Prepare for a Labor Case
Arrange your documents chronologically and gather the following where available:
Employment contract, amendments, and work permit.
Civil ID and employer details.
Bank statements and salary transfers.
Termination or resignation letter and related correspondence.
Leave and attendance records, and evidence supporting the claims.
Settlement releases or acknowledgments of receipt, if any.
Complaint number and records of follow-up or referral.
It is helpful to prepare a separate schedule for each claim showing the amount, period, calculation method, and supporting document. This helps identify missing information and avoid claiming the same amount under more than one heading.
Deadline for Appealing a Labor Judgment
As a general rule, the deadline for appealing an appealable judgment on the merits is thirty days, unless a specific provision applies. The period runs from the date of judgment, or from service of the judgment in the circumstances specified by law.
Expedited handling of a labor case does not automatically make its judgment on the merits a judgment in an urgent matter.
The judgment and attendance history should be reviewed immediately after issuance to determine the correct deadline and whether an appeal is available.

Does a Judgment Mean You Will Receive Your Money Immediately?
Obtaining a judgment and recovering the money are different stages. Payment may be voluntary, or recovery may require enforcement proceedings.
When asking about the timeframe, clarify whether you mean obtaining a judgment or actually receiving the money owed.
It is also useful to discuss settlement options and payment terms with your lawyer, including the precise amount, payment date, and effect of the agreement on the claims.
How to Track a Labor Case
Before referral, follow up on the complaint with the competent labor authority and retain its reference number.
After the court case is registered, use the judicial inquiry services on the Ministry of Justice website. Select the search method appropriate to the case number you have and enter the required details.
Do not assume that the labor complaint number is the same as the court case number. Keep each reference together with the name of the authority that issued it.

Frequently Asked Questions
Will a labor case finish within one month?
The one-month period concerns referral when settlement is unsuccessful under Article 146. It is not a deadline for completing every stage of litigation and recovery.
Can the duration of my case be estimated before filing?
An initial estimate can be discussed after reviewing the documents and claims, with an explanation of the factors that may change it. A specific completion date cannot be guaranteed.
Are labor cases exempt from court fees?
Article 144 exempts cases brought by workers or those entitled through them from court fees. However, the court may order all or part of the costs against the claimant if the claim is rejected. This does not mean that every party or every expense is exempt.
How can a lawyer help manage the case timeline?
By reviewing documents, organizing claims and calculations, monitoring hearings, court directions, and deadlines, and explaining how each step affects the proceedings.
