Garnishment to Recover Maintenance Debt in Kuwait: Requirements and Procedures

Garnishment to Recover Maintenance Debt in Kuwait: Requirements and Procedures

Garnishment to recover maintenance debt in Kuwait is a legal mechanism for collecting maintenance from a debtor’s assets held by a third party, such as a bank or employer. Attaching those assets and obtaining payment from them are separate stages, each subject to legal requirements and procedures.

This article explains third-party garnishment, its main procedural steps, and the documents to prepare when seeking enforcement of a maintenance judgment.

What Is Third-Party Garnishment?

Third-party garnishment involves attaching assets or financial entitlements belonging to a debtor but held by another person or entity. It involves three parties:

Party

Meaning

Attaching creditor

The person entitled to maintenance who requests the attachment

Judgment debtor

The person responsible for paying maintenance

Garnishee

The entity holding the debtor’s assets, such as a bank or employer

Article 227 of Kuwait’s Civil and Commercial Procedures Law permits a creditor with an established debt that is due for payment to attach the debtor’s assets held by a third party, subject to the applicable legal requirements.

Must a Maintenance Judgment Be Final Before Enforcement?

A maintenance judgment does not generally have to become final before enforcement can begin. Maintenance judgments are enforceable on an expedited basis by operation of law, subject to enforcement procedures and any judicial order staying enforcement.

The judgment and its enforceability should therefore be reviewed individually. Filing an appeal should not automatically be treated as preventing enforcement.

Not every form of third-party attachment requires an enforceable instrument. Article 229 regulates judicial authorization for attachment where the creditor lacks such an instrument or the debt amount has not been determined. This procedure differs from collecting funds under an enforceable judgment.

Procedures for Garnishment to Recover Maintenance

The practical process starts with reviewing the judgment, outstanding amounts, and enforcement file. The main stages include:

  1. Calculating the outstanding amount: Prepare a clear account of maintenance arrears, deducting payments already established.

  2. Reviewing the enforcement instrument and procedures: Verify enforceability and compliance with service requirements.

  3. Identifying the garnishee: This may be a bank, employer, or another entity owing money to the debtor.

  4. Preparing the garnishment notice: Include the instrument relied upon, the principal amount and related sums, and the parties’ details.

  5. Notifying the debtor of the attachment: Observe the statutory deadline.

  6. Following up on the disclosure, deposit, and payment: Further steps depend on the attachment’s outcome and the status of the enforcement file.

A key deadline: The debtor must be notified of the attachment within eight days following service on the garnishee. Otherwise, the attachment is treated as having no effect. Where there are multiple garnishees, the deadline is calculated separately for each one.

Where Must the Garnishee Submit Its Disclosure?

Under the amendments introduced by Decree-Law No. 59 of 2025, the garnishee’s disclosure must be submitted to the Enforcement Department handling the proceedings within ten days of service, subject to the statutory provisions concerning deposits.

The amendments also address continued reporting of additional assets or credit balances belonging to the debtor until the attachment is lifted by the Enforcement Department. Older forms referring to submission to the Court of First Instance’s Registry should therefore be reviewed before use.

Documents to Prepare

To facilitate an initial review of the enforcement request, prepare:

  • The judgment or other instrument relied upon, including its enforceable copy where applicable.

  • Available proof of service.

  • The parties’ identification details and civil identification numbers.

  • The enforcement file number, if a file has already been opened.

  • A detailed statement of outstanding amounts and the periods they cover.

  • Receipts and records of previous payments or transfers.

  • Available information about the debtor’s employer or bank.

  • A power of attorney where a lawyer will conduct the proceedings.

This is an initial preparation checklist. Additional documents may be required depending on the judgment and the previous steps taken in the file.

Garnishment of Bank Accounts or Employment Entitlements

Garnishment Through a Bank

If the debtor has a bank balance, garnishment may be directed to the bank through the prescribed legal procedures. Where the debtor’s assets are unknown, Article 204 bis allows requests for disclosure of assets held with banks and other specified entities, subject to its requirements and through the competent enforcement authority.

Garnishment Through an Employer

Garnishment may be directed to an employer in respect of the debtor’s attachable employment entitlements. Salary and wage attachment limits depend on the applicable legal rules. It should not be assumed that the entire salary can be deducted or that one percentage applies in every case.

Mistakes to Avoid When Enforcing a Maintenance Judgment

An early review of the file can help prevent mistakes such as:

  • Including amounts already paid in the maintenance arrears.

  • Confusing attachment with entitlement to receive the attached funds.

  • Using inaccurate details for the debtor or garnishee.

  • Failing to monitor service requirements and deadlines.

  • Assuming that an attachment guarantees immediate recovery of the full debt.

Illustrative calculation: If maintenance arrears total KWD 1,200 and documented payments amount to KWD 300, the remaining balance is KWD 900, before any legally recoverable expenses.

Frequently Asked Questions

Does Garnishment Mean I Will Receive Maintenance Immediately?

No. Attaching assets is a separate stage from payment. Recovery depends on the availability of attachable assets and completion of the required enforcement procedures.

What Is the Difference Between Bank Account Garnishment and Employer Garnishment?

Bank account garnishment concerns funds held by a bank. Employer garnishment concerns entitlements held by the debtor’s employer. In both cases, the nature of the funds and the applicable attachment limits must be considered.

What If I Do Not Know Which Bank the Debtor Uses?

The enforcement file can be reviewed to assess a request for disclosure of the debtor’s assets through the competent authorities under Article 204 bis.

Is There a Fixed Timeframe for Recovering Maintenance Arrears?

No uniform timeframe can be guaranteed. Recovery depends on valid service, available assets, competing attachments, and disputes that may arise during enforcement.

Legal Advice on Garnishment for Maintenance Recovery

If you have obtained a maintenance judgment and are having difficulty collecting payment, the practical starting point is to review the judgment, calculate the arrears, and check the steps already taken in the enforcement file.
