Child Maintenance Claims in Kuwait: Requirements, Procedures, and Assessment

Child Maintenance Claims in Kuwait: Requirements, Procedures, and Assessment

A child maintenance claim in Kuwait provides a legal means of seeking financial support for children when a dispute arises over their expenses. Preparing the claim requires identifying the maintenance items requested, establishing the children’s needs, and presenting evidence of the financial capacity of the person responsible for supporting them, subject to the law applicable to the family.

This article explains claims covering food and clothing expenses, the documents needed, the factors relevant to assessing maintenance, and the difference between an initial maintenance claim and an application to increase or reduce an existing award.

What Does a Child Maintenance Claim Covering “Both Types” Mean?

The expression “maintenance covering both types” is used in some legal pleadings to refer to food and clothing expenses. When preparing a claim in Kuwait, however, each requested item should be identified expressly, including whether the claim covers housing, education, or medical treatment.

The expression does not mean applications to increase and reduce maintenance. Those applications concern changing an amount that has already been determined.

Precise drafting helps clarify the scope of the claim and avoid counting the same expense under more than one item.

The Legal Basis for Child Maintenance in Kuwait

Where Personal Status Law No. 51 of 1984 applies, Article 202 requires a father with sufficient financial means to support his child who lacks resources and is unable to earn a living, until the child becomes financially independent.

Article 203 addresses circumstances involving the father’s financial hardship or absence where maintenance cannot be recovered from him. It also regulates the resulting obligations of a financially capable mother or another person legally responsible for maintenance, subject to the statutory conditions. A father’s financial hardship therefore does not, by itself, end the child’s entitlement to support.

The applicable law must be identified before preparing the claim. Different provisions may apply depending on the family’s circumstances, including cases governed by the Jaʿfari Personal Status Law.

Can Child Maintenance Be Claimed Before Divorce?

A child’s entitlement to maintenance does not depend solely on the parents being divorced. It depends on whether the legal conditions for entitlement are met.

Where a dispute arises during marriage, the children’s needs and the support actually being provided should be reviewed.

Keeping bank transfer records, invoices, and correspondence concerning expenses can help establish what has been paid and what remains disputed.

Which Expenses Should Be Identified in the Claim?

To prepare an organised case file, it is advisable to list each child’s needs separately:

Expense Item

Useful Documents and Information

Food and daily necessities

A statement of ordinary expenses appropriate to the child’s age

Clothing

Seasonal needs and available invoices

Education

Enrolment certificates, tuition fees, transport costs, and school supplies

Medical treatment

Medical reports, prescriptions, invoices, and insurance coverage details

Housing

The tenancy agreement and details of the actual accommodation

This table helps organise the claim. It does not mean that every item will automatically be awarded or that the court will grant the amounts requested. Each request has its own conditions and supporting evidence.

Regarding accommodation for a child in custody, Article 198 provides an exception where the female custodian owns a residence in which she lives or has accommodation allocated for her use. Housing allowance should therefore not be presented as automatically payable in every case.

Documents Needed for a Child Maintenance Claim

The documents required depend on the dispute. It is useful to prepare:

  • Civil identification cards and the children’s birth certificates.

  • The marriage or divorce certificate, as applicable.

  • Previous custody and maintenance judgments, if any.

  • Lawfully available evidence of the father’s income.

  • A detailed statement of the children’s needs and expenses.

  • Bank transfer records and receipts showing payments.

  • Relevant educational and medical documents.

  • A power of attorney where a lawyer will handle the proceedings.

Monthly expenses should preferably be separated from annual or exceptional expenses, with documents arranged chronologically.

Procedures for Filing a Child Maintenance Claim in Kuwait

Preparing and pursuing the claim generally involves the following steps:

  1. Reviewing the legal position: Identifying the applicable law, the claimant’s legal standing, and the competent court.

  2. Defining the requests: Specifying the maintenance items, the amounts sought, and the grounds for claiming them.

  3. Preparing the statement of claim: Setting out the facts and attaching supporting documents.

  4. Completing filing and service: Following the required procedures before the competent Family Court.

  5. Submitting evidence and responses: Clarifying needs, income, and previous payments.

  6. Following up on judgment and enforcement: Reviewing the operative terms of the judgment and taking the appropriate steps to collect the amounts due under the enforceable instrument.

Each case requires an individual review. Legal standing, requests, and supporting documents may differ even between apparently similar cases.

How Much Is Child Maintenance in Kuwait?

There is no single amount or fixed percentage of salary that applies to every child maintenance case. A practical assessment requires information about income, the child’s needs, age, health, and education, together with existing financial obligations and payments.

A range such as “KWD 50 to KWD 100” should not be presented as a guaranteed judicial average. Meaningful comparisons require documented judgments involving comparable circumstances and a clear understanding of the expenses covered by each award.

From What Date Does Child Maintenance Become Payable?

Article 205 provides that maintenance for relatives becomes payable from the date the claim is filed or an agreement is reached. It constitutes a debt that is discharged only through payment or release, subject to the rules governing dealings with children’s rights and the necessary legal authority.

A distinction must therefore be made between seeking maintenance for the first time and claiming arrears under an existing judgment or agreement.

Increasing or Reducing Child Maintenance

Where a previous judgment exists, assessing an application for adjustment begins by comparing the circumstances at the time of the judgment with the current circumstances.

The application should be supported by clear evidence of the alleged change, such as new educational or medical expenses, or changes in income and financial obligations.

The conditions and time requirements for bringing an adjustment claim must also be reviewed under the applicable law. The passage of one year should not be treated as an absolute requirement without examining the relevant provisions and exceptions.

When Does Child Maintenance End Under Kuwaiti Law?

Article 202 links entitlement to the child’s lack of resources and inability to earn a living until financial independence is achieved.

Reaching a particular age alone is therefore insufficient to determine whether maintenance ends. The conditions of entitlement, earning capacity, available resources, and other relevant legal provisions must be considered.

Where an existing judgment remains in force, the appropriate legal procedure for seeking its variation or ending the obligation should be reviewed before deciding to stop payments.

Frequently Asked Questions

How Long Does a Child Maintenance Case Take in Kuwait?

The duration varies depending on service of proceedings, the completeness of the documents, disputes over income, and the number of hearings. A uniform timeframe cannot be guaranteed.

Can Temporary Maintenance Be Requested for Children?

Yes. An application for temporary maintenance may be considered subject to its legal conditions. Article 207 applies the provisions of Article 79 concerning temporary maintenance to maintenance for relatives.

Can a Father Deduct a Debt Owed by the Mother from Child Maintenance?

Article 206 prohibits setting off maintenance owed by a father to his child against a debt owed to him by the female custodian.

How Should a Maintenance Claim for an Infant Be Prepared?

It is advisable to prepare a statement of the infant’s actual needs, such as feeding, nappies, and medical treatment, supported by available documents. Any claim for breastfeeding remuneration should be identified separately and its entitlement conditions reviewed.
