Marriage Under Kuwait’s Personal Status Law: Requirements and Registration Procedures
Kuwait’s Personal Status Law governs marriage contracts, including their requirements, essential elements, and dowry provisions. Under the 2025 amendment, a marriage contract cannot be officially registered or authenticated if either party is under 18 at the time of registration. Couples should therefore confirm their eligibility and prepare the required documents before approaching the competent authority.
This article explains the provisions of Law No. 51 of 1984, as amended. The applicable legal framework must be determined according to each couple’s circumstances, as certain cases are governed by separate rules.
Marriage Requirements Under Kuwait’s Personal Status Law
The main requirements include:
Offer and acceptance: Article 8 provides for an offer by the bride’s guardian and acceptance by the groom, or their respective representatives.
Valid contractual wording: The offer and acceptance must correspond and satisfy the legal requirements.
Witnesses: Two witnesses who meet the prescribed legal conditions must attend.
Absence of marriage impediments: There must be no permanent or temporary legal prohibition preventing the marriage.
Capacity and consent: The parties must meet the applicable capacity requirements, and consent must be free from coercion.
Guardianship: The guardianship rules applicable to the bride’s circumstances must be observed.
Marriage Registration Age in Kuwait After the 2025 Amendment
Decree-Law No. 10 of 2025 replaced Article 26, establishing 18 years of age as the minimum age for registering or authenticating a marriage contract for both parties.
The amendment was published in the Official Gazette on 16 March 2025 and took effect on that date. Older information referring to a minimum age of 15 for females and 17 for males does not reflect the amended provision.
Documents Required for a Marriage Contract in Kuwait
The required documents vary depending on nationality, marital status, and employment circumstances.
Applicant’s circumstances | Required document |
|---|---|
Kuwaiti citizens | Civil ID or nationality certificate |
Residents | Civil ID or passport |
Divorced bride | Divorce certificate |
Widowed bride | Certificate of heirs |
Deceased guardian | Certificate of heirs to establish the appropriate guardian |
Application through a representative | Appropriate special power of attorney |
Kuwaiti groom serving in the military | Marriage permission from the employer |
Cases requiring social insurance documentation | Certificate from the Public Institution for Social Security |
Kuwaiti applicants | Premarital medical examination certificate issued by the Ministry of Health |
Embassy approvals may also be required for certain nationalities. Applicants should confirm the requirements for their circumstances before attending.
Marriage Registration Procedures at Court
The process generally involves the following steps:
Identify and prepare the documents required for both parties.
Complete the premarital medical examination and obtain any necessary approvals.
Attend the competent Sharia Documentation Department or marriage documentation office.
Arrange attendance by the couple, the bride’s guardian, and two witnesses, subject to the applicable rules on special powers of attorney.
Complete the application form, pay the fees, and finalize the marriage contract procedures.
The government service portal lists a fixed fee of KWD 1 and an additional KWD 6 attendance fee when the court representative travels outside the court. These government service fees are separate from legal consultation fees.
Dowry and Deferred Dowry Under Kuwaiti Law
The law does not prescribe a minimum or maximum dowry. A validly specified dowry is payable; where no dowry is specified, or its specification is invalid, a comparable customary dowry—known as mahr al-mithl—is due.
Part of the dowry may be deferred. A specified payment term ends upon an irrevocable divorce or death. The full dowry becomes established upon actual consummation, valid marital seclusion, or the death of either spouse.
Clearly recording the immediate and deferred amounts, together with any payments already received, can help reduce future disputes.
Preparing for a Legal Consultation Before Marriage
To make the consultation useful, prepare identification documents, any previous marriage or divorce records, available approvals, and a list of the matters you would like explained.
Mention any difference in nationality, documents issued abroad, or difficulty involving the guardian at the outset. These details help determine the appropriate procedure.
A consultation may include reviewing documents, explaining dowry provisions, and discussing proposed contractual conditions before the marriage contract is completed.
