Discharge of Maintenance Debt in Kuwait: Requirements, Procedures, and Proof of Payment
A claim for discharge of maintenance debt in Kuwait seeks a court declaration that the claimant no longer owes a specified maintenance amount. This may be because the debt has already been paid or validly released by the person entitled to it. The appropriate procedure depends on whether a maintenance case is pending, a judgment has been issued, or enforcement proceedings are underway.
The starting point is to identify the type of maintenance, the period claimed, the amount in dispute, and the evidence of payment or release.
What Does Discharge of Maintenance Debt Mean?
Discharge means establishing that a specified maintenance debt is no longer owed, either wholly or partly, on a legally established basis.
Article 78 of Kuwait’s Personal Status Law No. 51 of 1984 provides that spousal maintenance becomes a debt when the husband fails to provide it despite being legally required to do so. A judgment or agreement is not required for the debt to arise. The provision addresses its discharge through payment or release, subject to the following paragraph of the Article.
Discharge of specified arrears does not exempt a person from future maintenance obligations. Each claim must be assessed according to the type of entitlement and the period concerned.
The applicable law must also be identified before relying on particular provisions, especially in cases governed by Jaafari personal status rules or involving a foreign element.
When Might You Need to Establish Discharge of Maintenance Debt?
A review of the claim and supporting documents may be needed where:
Maintenance is claimed for months that have already been paid.
Payments have not been credited to the enforcement file.
A receipt or settlement acknowledgment exists, but payment is still being demanded.
A release of accrued maintenance debt exists, but its validity or scope is disputed.
The same amount is included in more than one claim for the same period.
Part of the arrears has been paid, but the full amount remains claimed.
Example: If a claim covers six months of maintenance and documents establish payment for four months, those payments should be identified and credited. Any remaining balance should be stated, rather than seeking discharge of the entire debt without supporting evidence.
What Is the Difference Between Discharge, Loss of Entitlement, and Reduction of Maintenance?
Issue | Meaning |
|---|---|
Discharge of maintenance debt | Establishing that a specified amount is no longer owed because of payment, a valid release, or another established legal ground |
Loss of maintenance entitlement | Determining whether a legal ground affects entitlement for a particular period |
Reduction of maintenance | Seeking an adjustment to the maintenance amount under the applicable legal conditions |
Challenge to the arrears calculation | Reviewing the periods and amounts claimed and establishing payments that have not been credited |
This distinction helps identify the correct request. Proving payment is different from challenging the amount awarded or seeking to change it.
Documents Used to Establish Payment of Maintenance
The documents required depend on the circumstances. The following should generally be gathered:
Document | Purpose |
|---|---|
Maintenance judgment or agreement | Identifies the amount due and when the obligation began |
Statement of the claim or arrears calculation | Identifies the disputed periods and amounts |
Bank transfers and account statements | Establishes transferred amounts, payment dates, and the recipient |
Enforcement payment receipts | Shows payments officially recorded in the enforcement file |
Settlement acknowledgments and receipts | Establishes receipt of specified amounts and the entitlement concerned |
Settlement record or release | Defines the agreement’s scope and the period it covers |
Correspondence concerning payment | Helps explain the purpose of payments and their connection to maintenance |
A bank transfer alone may not always resolve the dispute. The parties may disagree about its purpose or the period it covers. Where possible, the transfer reference should identify the maintenance type and the relevant month, and the original records should be retained.
How to Seek Discharge of Maintenance Debt in Kuwait
1. Review the Basis of the Claim
Review the judgment or agreement to identify the maintenance beneficiary, the amount payable, the due dates, and the period for which payment is being established.
2. Prepare a Schedule of Amounts Due and Payments Made
Organize the schedule by month, showing the amount due, the amount paid, the payment date, and the supporting document. This can help identify duplicate claims or calculation errors.
3. Identify the Appropriate Procedure and Competent Authority
Payment may be raised as a defense in a pending maintenance case. In other circumstances, a separate claim or an enforcement dispute may be appropriate.
The Family Court Law contains specific provisions governing disputes concerning enforcement of its judgments. The same procedure should therefore not be assumed to apply to every case.
Any family settlement requirements should also be reviewed before filing, depending on the type of claim. Kuwait’s Ministry of Justice provides a family dispute settlement service with its own procedures and documentation requirements.
4. Draft Precise Requests
The claim should specify the maintenance amount, the disputed period, and the basis for discharge. Each factual assertion should be linked to its supporting evidence.
5. Follow Up on the Case and the Judgment’s Effect
Once the dispute is decided, the appropriate steps should be taken to give effect to the judgment in the claim or enforcement file, within the amounts and periods covered by its operative provisions.
Does the Passage of Two Years Extinguish Maintenance Debt?
The passage of two years should not be treated as an automatic discharge of all maintenance arrears.
Paragraph “b” of Article 78 addresses the non-hearing of a claim for spousal maintenance relating to a period more than two years before the filing date, with an exception for maintenance established by agreement. This rule must be distinguished from the recovery of maintenance already awarded by a court judgment.
Accordingly, one year passing after divorce, combined with a release covering the preceding year, does not by itself establish that a statutory period has expired and extinguished the debt. The release, the period claimed, and the legal basis of the claim must each be examined separately.

Frequently Asked Questions
Does a Bank Transfer Prove Payment of Maintenance?
It may be relied upon as evidence of payment. Its connection to maintenance and the period it covers should be established, especially if the parties disagree about the transfer’s purpose.
Can Discharge Be Established for Only Part of the Arrears?
Yes. The amount proven to have been paid can be identified and credited, while any remaining balance is stated separately.
Does a Wife’s Release Include Child Maintenance?
This should not be assumed. Child maintenance is a separate entitlement. The identity of the rights holder, the authority of the person granting the release, and its legal validity must be examined.
Does Filing a Discharge Claim Automatically Suspend Enforcement?
Filing the claim alone should not be relied upon to suspend enforcement. The applicable enforcement rules must be reviewed, and an appropriate application submitted to the competent authority where the legal requirements are met.
How Long Does a Maintenance Debt Discharge Case Take?
There is no single timeframe for all cases. The duration depends on service of proceedings, the available documents, the nature of the dispute, any necessary accounting review, and the stages of litigation.
