When Is a Wife Entitled to Maintenance in Kuwait? Conditions, Loss of Entitlement, and How to Claim
A wife is entitled to maintenance in Kuwait under a valid marriage contract if she makes herself available for marital cohabitation, whether actually or constructively, even if she is wealthy or earns a salary, under Article 74 of Personal Status Law No. 51 of 1984. Entitlement therefore depends on meeting the legal conditions and does not necessarily begin on the marriage contract date in every case.
To assess your entitlement, identify when financial support stopped, your living arrangements, payments previously received, and any agreements or court judgments between you and your husband.
What Does Spousal Maintenance Cover, and How Is It Calculated?
Maintenance includes food, clothing, housing, and related expenses such as medical treatment, domestic assistance, and other customary needs. Under Articles 75 and 76, it is assessed according to the husband’s financial circumstances and must meet the wife’s minimum essential needs.
When preparing a claim, organize your actual expenses and supporting documents rather than relying on a total estimate without explaining how it was calculated.
Can a Wife Claim Maintenance for Previous Years?
Unpaid maintenance becomes a debt from the date the husband stops providing support while legally obliged to do so. It is discharged only through payment or release by the wife.
However, Article 78 generally limits claims for past maintenance to the two years preceding the filing date, with an exception for maintenance established by mutual agreement. If the husband denies that agreement, it must be proved in writing.
Keep bank statements, transfers, and correspondence in chronological order to help establish what was paid and what remains outstanding.
When Does a Wife Lose Her Entitlement to Maintenance in Kuwait?
Article 87 addresses loss of maintenance for a period of refusal established by the court when a wife, without a legally valid reason, refuses to move into the marital home or prevents her husband from living with her in her home, subject to the statutory conditions. Marital disobedience is established only when she refuses to comply with a final judgment requiring marital cohabitation.
Valid reasons for refusal include concerns for her safety with her husband, nonpayment of the immediately payable dowry, or failure to provide suitable marital accommodation. They also include failure to provide maintenance where enforcement of a maintenance judgment is impossible because the husband has no apparent assets.
Under Article 89, leaving home for a lawful purpose or permissible employment that does not conflict with the family’s interests does not constitute marital disobedience.
If there is a dispute about leaving the marital home, record the reasons and relevant dates, and gather supporting documents and correspondence for your lawyer to review.
Does Khula Automatically Cancel All Maintenance Entitlements?
It is inaccurate to assume that khula automatically eliminates all previously accrued financial entitlements. Khula involves compensation agreed upon by the spouses, while accrued maintenance is discharged through payment or release.
The wording of the khula agreement must therefore be reviewed to identify precisely which rights it covers.
Before signing an agreement, request clarification of the amounts, periods, and rights included, and retain a complete copy.
How Can You Prepare to Claim Maintenance?
To help assess your circumstances and prepare your claim, gather the following documents where available:
Your marriage certificate and civil ID.
Your husband’s details, address, and employer information.
Records of transfers and payments received.
Supporting documents for housing, medical treatment, and essential expenses.
Previous judgments, settlement agreements, or khula agreements.
A brief timeline showing when financial support stopped.
You may also request temporary maintenance while the case is pending. Article 79 allows the judge to order temporary maintenance at the wife’s request, with immediate enforceability.

Frequently Asked Questions
Does a Wife’s Salary Remove Her Entitlement to Maintenance?
No. Article 74 provides for maintenance even if the wife is financially well-off, provided the legal conditions are met.
Does Leaving the Marital Home Immediately Cancel Maintenance?
No. The reasons for leaving, the legal conditions for losing entitlement, and the applicable judicial requirements must be examined, taking legally recognized justifications into account.
What Should I Bring to the First Consultation?
Start with your marriage certificate, any previous judgments or agreements, bank transfer records, and a short timeline of the issue. Identifying payments received and the disputed period will help make the consultation more focused.
